from piedmont high in 1978 before becoming a student at berkeley. david levine says he taught law in san francisco. >> he was interested in international law. this was always his dream job. >> flowers and notes were delivered today to the home of stevens' parents. they will be flying to washington, d.c. tomorrow. president obama is vowing that justice will be done in the aftermath of the deadly attack in benghazi. as emily reports, the events of the day triggered not only condemnation, but a political row. >> reporter: there was a range of statements, from symbolic to severe. >> the united states condemns in the strongest terms this outrageous and shocking attack. >> reporter: the sentiment crossed party lines. >> i join my colleagues in strongly condemning the murder of these innocent americans. >> reporter: ambassador stevens was killed in a rocket attack at the u.s. consulate on

tuesday, the same day that the u.s. embassy in egypt was attacked. libya said the crowd was angered by an online movie considered offensive to islam. >> we apologize to the u.s. and to the american people and to the government and also to the rest of the world for what happened yesterday. >> reporter: president obama says the attack will not break the bonds between the u.s. and libya, though he underscored the seriousness of the situation. >> we will not waiver in our commitment to see that justice is done. >> reporter: u.s. officials say the u.s. has deployed a group of marines to libya to help secure facilities there. republican presidential candidate mitt romney says the administration's response to the attack sends mixed signals. >> the world remains a dangerous place and american leadership is still sorely needed. >> reporter: the obama campaign has accused romney of launching a political attack in the midst

of a diplomatic challenge. sources tell us that they believed that an attack in benghazi was preplanned. they do not believe ambassador stevens was a specific target. in washington, i'm emily schmidt. members of the bay area muslim community also condemned the deadly attack on the consulate and expressed sadness for the families of the four americans. many say they also fear that the violence may feed into a distorted stereotype that some may have of all muslims. they say the very fabric of islam is peace and when an extremist faction commits horrific violence, mainstream muslims feel they must defend their religion. >> violence anywhere sets us all back. >> bay area muslim leaders we spoke with say they don't expect any backlash but they intend to be extra cautious. the youtube video that

ago today. amber nelson feels compelled to come here in berkeley. >> i'm kind of just following his example about the way to bring beauty and happiness to the world. >> reporter: she imagines a time when police solved the killing of her fiance, whose nickname was feto. she created this garden sanctuary because this is where he was shot to death, in front of her, on his 35th birthday, in 2010. >> how often do you come here? >> every day. usually -- well, sometimes two, three times a day. but every single day. you know, sometimes i only stay for ten minutes. sometimes i stay for four hours. >> reporter: today, they were reminding the bay area of this case, because feto moved here from chile after he and nelson met and fell in love. >> he was an idealistic person, a sort of artist as well. he liked to do theater. >> reporter: berkeley police admit it's been tough to close this case because the killing

happened during a robbery at 3 in the morning when few, if any, people were around to witness it. >> we can't bring him back but we would like to be able to find a little bit of closure to say we did find the people who did this. >> reporter: nelson shared with us a note from fito's mother in chile. >> fito loved life and he had wonderful plans to change the world. >> reporter: fito's family wanted to be here, but they stayed home today to celebrate the birthday of fito's twin sister. there is a $20,000 reward offered in this case. santa clara county prosecutors announced today they will not seek perjury charges against a former priest accused of child molestation. the allegations stemmed from jerold lindner's testimony in the trial of william lynch. prosecutors say they believe lindner was being untruthful

when he denied child but that i enough to qualify as perjury. >> the trial was about whether mr. lynch assaulted mr. lindner. it wasn't the fact that -- the fact that he died about molesting him was not relevant to the jury. we now have new surveillance video to share with you of that damaging fire last month at the chevron refinery in richmond. you can see a big black column of smoke rising from the refinery. federal investigators have also revealed that the corroded pipe had walls as thin as a penny in some areas. they are now investigating why chevron didn't replace that pipe one year ago. a man in a wheelchair was rescued from a burning apartment overnight. more than a dozen people were

evacuating the building. the man was trapped inside. it took about an hour to put this fire out. the cause of this fire is under investigation. california governor jerry brown is set to attend tomorrow's funeral for chp officer kenyon youngstrom. it will be at the mission church in vacaville. officers escorted youngstrom's body to a morgue. since there is not enough room for the public to attend the service, we will be streaming the funeral live at www.ktvu.com. the online coverage starts at 10 a.m. tomorrow. the 49th annual ren know air races roared back into the skies today, one year of a plane slammed into the ground, killing 11 people. this year, concrete barriers are in place between the racers and the spectators. spectators said even with these

changes, the race is still great. >> i still get goose bumps. >> the first full day of racing is tomorrow. it will include a tribute to the victims and first responders of last year's plane crash. people in san francisco could soon have a new way to get around the city. the san francisco port commission just approved plans for a water taxi. it would shuttle passengers between the marina. tickets are expected to start at $10 per person. officials in contra costa county say that more mosquitos and five dead birds have tested positive for west nile virus. according to the mosquito and vector control district, the risk remains elevated in the eastern part of the county. two of the dead birds were found in brentwood and three in

look at these people just running out in the street. >> a long and winding police chase that played out on live tv drew crowds into the streets. sheriff's deputies were chasing an suv involved in a bank heist in santa clarita. at one point, the suspects threw money out of the window. authorities swooped in and arrested two men. robbed and pistol whipped at her own home in oakland. tonight, a woman is talking about what happened and the policy that may have delayed paramedics from coming to her aid. here is the woman's chilling story and the possible changes her story is generating. >> what happened to me could happen to anyone. it was in the middle of the

day, in broad daylight. >> reporter: this woman asked us not to reveal her identity, after concern for her safety, after being attacked at her own home near oakland's diamond district less than two weeks ago. >> they threatened me with a gun and began beating me, so it was a horrific thing. my son, at a very young and tender age, witnessed the entire thing. >> reporter: bleeding, these says neighbors were the only ones coming to her aid for 20 minutes. >> we put out additional calls for help and we waited and waited and waited. and there was no response for a very, very long time. >> reporter: police say an unusual series of priority one calls that day delayed officers. and even though firefighters were waiting nearby, department policy requires them to get an all clear from police before they can respond to any incident involving a gun. >> those policies are being looked at by the individual agencies, and together we are

working on a solution where we can best serve the community. >> reporter: oakland police say they've also increased patrols in the neighborhood. >> the screaming, i'm sure, saved my life. and now we all need to scream and talk about this. >> reporter: the deputy chief confirmed the department is talking with police about improving communication when there's no longer a threat but he says the policy is there for everyone's safety. as for this woman's case, police say it is an active investigation and they are following leads. palo alto police say that home burglaries are on the rise and the department is taking action. there have been 151 burglaries so far this year. that's up almost 65% from last year. police say they are stepping up their lock it or lose it program. bits of remains of a

prehistoric mammoth may provide scientists new clues about the past. mammoths roamed the earth years ago. they found a jawbone below ground. the fossils are about 11,000 years old. the fossils can be used to understand past climates, global warming and help predict future climate patterns. the rush prime minister says three members of a female punk rock band should be released. the three have served six months of a two-year sentence for performing an anti-kremlin song. he said he did not approve of the performance but that further incarceration would be unproductive. germany's high court has upheld a rule.

well, preorders start this friday. they start shipping next friday. it is apple's fastest roll-out ever. >> they tell us the iphone 5 did blow them away with a radical new design. but maybe it didn't have to. >> what you saw today was a manifestation of apple saying we're going to continue to do what we do until we feel we have to act otherwise. >> tech experts we talked to say that apple is still ahead of its competitors in the smartphone field. the company could sell as many as 10 million of the phones before the end of the months. apple stock rose more than nine points today. apple's latest iphone could set the stage for a flood of e- waste as consumers replace their old phones. the green citizen warehouse recycling center has collected piles of discarded electronics, including older-model iphones. they say they repair and reuse

warm weather. >> that's right, gasia. you will notice a temperature change. a few neighborhoods will be approaching the lower 90's as early as tomorrow. we have options here in the bay area. fog still keeping things chilly right near the immediate coastline. a solid fog bank out towards ocean beach. daly city and the western half of san francisco is covered with the overcast. the temperatures ranged from a chilly 59 degrees, 69 for oakland and some 80's out toward antioch. here we go with the forecast headlines for tonight. we do have this. mostly clear skies. some coastal fog. tomorrow clearing skies, a touch warmer in most spots. the weekend, overall, a fairly warm forecast. overnight lows will be in the 40's and some fog coast side. we could even have a few

patches develop in the north bay valleys. most areas in the 40's and 50's. we have sinking air. you probably felt it for today. it will continue to strengthen. as a result, temperatures tomorrow inland approaching the mid 90's but we'll have that steady on-shore breeze for the beaches. as a result, patchy fog. an increase in some of the fog coast side. i suspect a few patches around the day. then into the afternoon hours, increase in sunshine, partly sunny skies for the beaches. we might be a little optimistic here. you can see that orange contour, the reds. a few more 90's to talk about for your thursday. you can see that in clear lake, saint helena. livermore, right around 93. san jose, a forecast high of 84. these temperatures will check in right about 3:00 tomorrow
